Why you should have a Will

Very few of us actually get round to doing it!

Over 70% of the population do NOT have a valid Will

Without a Will:
  • You think that your spouse or civil partner will automatically receive everything. They won't.
  • If you are not married or in a civil partnership your partner will receive nothing from your estate.
  • Thousands of small heirlooms and treasures are lost to the auction rooms every year because no one can decide who should have them.
  • Millions of pounds are unnecessarily paid in inheritance tax because a Will has not been drawn up.
  • If your surviving spouse/partner has to go into nursing care then the family home will probably have to be sold to pay for it
  • If your spouse dies before you and your children are under 18, and your relatives cannot agree on guardianship, then a court will make the appointment.
  • If your spouse remarries, her/his new partner will get one half of everything she/he inherited from you.
  • The new spouse/partner need not spend anything on your children. Furthermore, on her/his death, she/he may exclude your children by merely writing a Will to that effect.
  • Stepchildren, Godchildren, Friends, Charities will receive nothing.
  • Some people think their affairs are too complex to sort out because of previous relationships, wayward children etc… This causes great hardship and delay.

With a Will:
  • There will be no delay because you have appointed Executors – Letters of Administration and long delays are not necessary.
  • You decide who will look after your children – not the courts.
  • You make sure that your children will benefit one day – not a future spouse/partner or their children.
  • You make sure that the local authority does not take the whole estate to pay for nursing care.
  • You make sure that your unmarried partner will benefit.
  • Most people would rather their money went to a charity than to the taxman if they have no one to leave it to.
  • You make sure that your beneficiaries legitimately benefit not the tax man. You have already paid tax once!
  • You make sure your pets and charities are looked after.
  • You decide who stays out of your Will as well as who goes in.
